Tier 2 Sponsorship Licence
We advise businesses seeking to apply for and renew sponsorship licences to enable them to appoint and retain foreign staff. We manage sponsorship management systems for businesses, which includes applying for and maintaining the sponsorship licence, and advising businesses on the Home Office's audit requirements.
Tier 2 Sponsorship Licences
UK-based organisations who wish to sponsor an individual from abroad so they can work in the UK under a Tier 2 visa need to obtain a sponsorship licence and, once licensed, assign a Certificate of Sponsorship to the individual applying for a visa. Tier 2 visas cover a number of categories and are most commonly needed by those who have been offered a skilled job in the UK, wish to work for a UK branch of an overseas employer or are elite sportspersons, wishing to stay in the UK on a long-term basis or permanently.
Sponsorship licences are granted by the UK Border Agency (UKBA) following a review of an application by UK Visas and Immigration (UKVI). To have an application accepted and registered, UKVI will check that the organisation meets the requirements for the relevant Tier 2 category and that it can carry out the specific sponsorship duties of keeping records and reporting on its sponsored applicant. It is also necessary to have a sponsorship management system in place run by people from within the business or organisation.
Applying for and maintaining a licence is an involved process. Merchiston Solicitors can advise on the best course of action and guide you through the procedures. We also advise on the following:
- preparing for a Home Office audit and deliver on-site training;
- implementing internal compliance strategies;
- developing practices and monitoring systems; and
- compliance with the Resident Labour Market Test.
