Tier 2 (General) Migrant Work Visas
The Tier 2 Visa is an important entry route into the UK for non-EU skilled workers. Entry under this visa scheme requires the applicant to be in possession of a job offer as well as a certificate of sponsorship(COS) from a UK based employer who has a valid Tier 2 Sponsorship Licence. There are four Tier 2 categories:
- General: relevant for individuals coming to the United Kingdom with a job offer and to fill a position that cannot be filled by a settled worker;
- Intra-Company Transfers: relevant for employees being transferred by an overseas employer to a skilled job in a UK-based branch of the same organisation;
- Sports People: relevant for elite sportspeople and coaches whose employment will make a significant contribution to the development of a sport at the highest level;
- Ministers of Religion: for those people coming to undertake a position as a Minister of Religion, Missionary or Member of a Religious Order.
We have extensive experience in Tier 2, both applying for migrant workers, who are in the UK and wish to switch from a Tier 4 or switchable category, and those prospective workers who wish to apply from their respective countries and are successful in their application.
Certificate of Sponsorship
If you wish to apply under Tier 2 from outside the UK, your employer will first need to undertake a resident labour market test to try and recruit a local worker for the job advertised. If unsuccessful, only then can he raise a COS to enable you to apply for leave to enter. It is a complicated process, as you also need to have sufficient points on maintenance and English language to qualify.
