We understand the need to keep your costs low especially when you are seeking legal advice. Although we do not provide advice on the phone, our solicitors will provide an initial 10 minute consultation on the telephone to establish an understanding of the facts to determine whether we can assist you. You can book an initial callback request online and a member of our team will contact you on the same working day.
If you would like to book an appointment to speak to solicitor, or wish to discuss your case further following a telephone consultation, you may visit our offices and see a solicitor for a detailed consultation. We will charge a reduced fixed fee including VAT for consultations with new clients. This includes a detailed letter confirming the advice you received from us on your case.
At the end of the meeting we will give you a cost estimate of further work that may be required on your case. If you then wish to proceed, our hourly rates will apply. Conditional Fee Arrangement (CFA)
We can on certain cases work with you on a reduced hourly rate. We therefore share the risk of your litigation. This means if your claim fails then you will not have to pay us anymore than our agreed hourly rate. However, if your case is successful we will be entitled to claim our basic hourly rate together with a success fee, which will be no more than a maximum of 100% of our basic hourly rate.
We will be able to recover most of these costs (aside from the success fee and the premium of ‘after the event’ insurance) from the other party in any event as part of the litigation principle that the loser pays the winner’s costs. However, our reduced costs agreement will not include Counsel’s fees, disbursements and Court fees.
Fixed Fees Arrangement (FFA)
At Merchiston Solicitors we are also able to offer a fixed fee arrangement to help reduce the financial bill for litigation. We can agree to fix fees for different stages of litigation, which will provide you some certainty as to the legal costs you are likely to incur and help you budget. Our fixed price services help keep the financial strain down to a minimum. A FFA may not be suitable in every case but we will advise you on the options available to you.
